PAPA PERKINS' PLEA. He Says He Had a Right to Tear tho Contract. The examination of T. E. Perkins, who was arrested on last Tuesday upon a charge of grand larceny,for the alleged stealing of a contract from the office of Gardner ('lark, the facts of which were exclusively published in the Hrkai.d a few days ago, came up yesterday morning before Justice Austin. The defendant was present, accom panied by his wife and married daugh ter, Mrs. Clark. The court room was crowded with an anxious throng of spectators, many of who mistook Mrs. Clark for her sister, the absent Louise Perkins. Many comments were passed as to her appearance, and the assemblage remained throughout the examination awaiting the time when Louise would take tho stand. Mrs. Perkins sat in tlie rear part of the room hidden behind a huge red fan, from behind which she occasion ally peered out. Perkins Hat beside his counsel, and during the proceed ings he pulled nervously at his mous tache, until he linally became evident ly convinced that he was wearing it away. He then amused himself by playing with his vest buttons. J. If. Gardner, one of the prosecuting wit nesses, was the first witness called. He told the story of the case as follows: "I first called upon Mr. Perkins last April, for the purpose of securing the agency for his property situated adjoining my land at Fulton Wells. I called to see him several times but without accomplish ing my purpose. Finally one after noon Mr. Clark and myself had a meeting, at which Mrs. Perkins was present. We debated the proposition and Perkins signed the contract with out our using any undue influence. Before Perkins appended his signa ture he suggested the advisability of consulting an attorney, but Mr. Clark told him that it was unnecessary. There was no undue influence used, and I supposed that Perkins signed the contract on account of its fairness. A few days after it was executed Mr. and Mrs. Perkins called at my office and wanted to rescind the instrument, but of course we would not consent. On last Monday they called again ac companied by their son-in-law, Mr. ('lark. They were very much excit ed, so much so that I refused to talk with them. They got np to leave and as they did so, Perkins grabbed the contract from the desk and tore it up. The contract is worth $11,000 to us. I paid Perkins a consideration of $1 when tho instrument was delivered to me. The last statement paralysed Mrs. Perkins, and she nearly fell off of the bench as she shook her head. Officer Fletcher testified to having arrested Perkins, and to having picked up the torn contract on the street. The prosecution rested and the defense opened with the testi mony of Mr. Perkins, who testified as follows: I was persecuted nearly to death by Gardner before I signed the contract. He promised to subdivide my property and immediately place it upon the market. He said that he was iroing to "boom" his land at Ful ton Wells and improve it. He has not done so. Ino sooner had signed the contract than 1 regretted it. I notified Gardner that I wanted to take my property out of his hands, but he would not consent. Last Monday I went into his office to talk with him, but he said "that I had no sense." f went to go out, and saw the contract on the desk. It was mine. I was bound to have it, and I got it and tore it up. I hud a right to do it. When Clark swore that he paid me a dollar on the con tract he swore to a deliberate false hood. A cent never passed between us. Son-in-law Clark took the stand, and his testimony coincided with his father in-law's. J. H. Gardner was recalled and in terrogated as follows: "Did you not, in the presence of Mr. Clark, state to a Herald reporter in answer to a direct question put by him, that you did not pay any money on that contract?" "If I did I did not understand the question. I thought he meant if I had improved the property." Mr. Clark was recalled, and he tes tified that he heard the statement made. Unruh returned from San Francisco yesterday whither he went to pay the taxes of Mr. Baldwin in that county. Ho says that there has been no increase whatever in the valuation of real property in San Fran cisco. Lots that were sold for $200 last year and have sold for $2500 since are assessed at the old time valuation of $50 each. The only increase in San Francisco has been on personal property and improvements and not on real estate. He says that the peo ple up there are laughing in their sleeves and congratulating themselves that Los Angeles will have to bear the greatest burden of state taxes this year. Give Assessor Mason one more show and Los Angeles county will pay in taxes every cent needed to run the State government and the rest of the counties can go scot free. The Foot Hill Railroad. A contract was made yesterday be tween the Foot Hill Dummy Bailway Company, that is building a line from the Ostrich Farm, via North Los An geles and the Cahuenga foothills, to Santa Monica and La Ballona, with Carter Brothers of Newark, for $37,000 worth of cars, to be made for that line. A large force of men is at work in grading the roadbed of this railway in various places along the line. It will pass the mammoth hotel at Cahuenga and run along the foothills to the Hancho Buenos Ayres, North Santa Monica, Santa Monica, South Santa Monica and Ballona Ha.l>or. Pullman Passengers.
