The law does not prescribe the order
or succession in which the names of
candidates shall be placed upon the bal
lot, but leaves this 0 the judgment and
discretion of the board. If the order or
succession of the names of candidates
varied upon the ballots prepared by
electoral boards, in my opinion the ballot
is legal.

The Attorneyv-General's opinion is not
distinct on the question to which we
wished a specific reply, but we think we
know what his meaning is. He means
that the electoral boards of the counties
have a discretion to print a number of
pieces of paper for each precinct and
to have the names of the candidates in
one order or succession upon one of the
pieces and in ancther order or succession
upon another of the pieces. All those bal.
lots, in the opinion of the AttorneyGen
eral, constitute in fact but one ballot.”
We believe, then, that the Attorney
General is of opinion that what was done
in our last election is sanctioned by the
law, 80 that the Dispatch has understood
him and we have not.
We think, however, that we owe it to
ourselves to re-print here the published
opinions of the Attorney-tieneral, upon
which we made up our opinion of his
views,

i. To Mr. Edward l. Scott, secre
tary of the electoral board Hanover
county, who asks “whether, th printing
the election tickets, it will be necessary
for me, as secretary of my board, to
print the names on the tickets in the
order of arrangement furnished by you
(Secretary of tne Commonwealth)? If
not, will you please advise me whether
our board must follow any particular ar
rangement of names on tickets”
I reply, “the ballot law" prescribes no
order or arrangement for the names of
candidates upon ‘the ballot; as 1 con
strue it, the arrangement and order in
which the candidates’ names are put
upon ‘“‘the ballot” is left to the judgment
and discretion of the electoral boards of
the cities and counties of the Common
wealth,
2. You ask that 1 give my opinion re-
garding the ballots to be used in the
vote upon the constitutional amendment

“The Walton ballot law" was passed
after the act which directs the proposed
constitutional amendment to be submit

other powers,

proposed amendment to the Constitution
shall be taken, and the right of the
electoral board to print upon “the Wal
ton ballot” the words following, viz,
“For the amendment to the Constitu
tion,” “Against the -amendment to the
Constitution.” Upon careful considera
tion 1 think it safest and best and ad
vise that the ballot prepared by the
electoral boards shall conform strictly 10
the requirements of “Section 5" of the
new law, and contain only the offices
voted for and names of candidates,

ballot, on the constitutional amendment,
and that these ballots ghall be placed in
a separate balloi-box prepared for that

Dear Sir: Ih reply to the questions con
tained in your letter of the 17th of Jan
uary past, 1 have to say:
First, County electoral boards must
prepare the ballot for the gpring elec
tions. There can be but ONE ballot, and
upon it the names of all candidates for
county and district officers. Like
the papers herein sent vou. (The paper
referred to here was pinned to the let
ter, and showed only the form of ballot.)
The tickets should be distributed in con
formity with the requirements ‘Section
7 of the Statutes (Acts 1833-'94, page
864).
Second. The duties imposed upon the
special constable by “Section 15" are
diffeult to define in words. He is under
obligation to help the two classes of
voters, namely: (1) Those physically and
educationally unable to vote. 2.) The
blind. He must assist both. For the
blind voter the constable prepares the
ballot. At the request of the voter in the
booth physically or educationally unable
to vote, the «pecial constable assists by
reading to him the names and offices on
the ballot, ard by pointing out to him
(the voter) the name or names he may
wish to strike out, or otherwise aid him
in preparing his baliot, meaning, as 1
read and understand thege words, ren
der such additional aid as the voter asks
from the constable,

Now, we thought that if there could be
only ONE ballot for a precinct that it
meant one niece of paper duplicated and
re-duplicated to twice the number of
voters at the precinct, as required by the
Walton law. We thought it meant that
each piece of paper should have on it
exactly what every other piece had on
it, and located just as those things were
located on the other piece. In other
words, we thought that ea h ballot should
be an exact reprint of every other bal
lod.
The Attorney-General may be right in
his construction of the law, though we
do not think he is, for we are utterly
unable to understand how three or more
ballots, each of which differs from the
others, can constitute one ballot,
However, while we do not agree with
the Attorney-teneral’s construction of
the law, our whole contention has been
that it was a most discreditable trick, and
we are just as much of that opinion, even
if it be lawful, as we would be if it were
unlawful.
Assuming that the Attorney-General's
opinion of the Walton law is correct,
we have the melancholy spectacle of tha
State itself solemnly providing to dec ive
her own voters, The Walton law is wirse
than we had supposed, 4
The proposition which Mr. Noble has
made for a change in the form of our
city government ought not to receive one
-mement's serious consideration. We are
heartily in favor of having the city gov
erned by a set of commissioners for ea h
department, but we waut to see those
commissioners coms from the people and
go back to the people at regular and short
periods. In other words, we want to see
the people continued in charge of their
own affairs, and we are totally opposed
to any proposition that will take from
them the guardianship of their business,
and depesit it for six years in the hands
of a selected body of men, If we could
consent, under any circumstances, (to an
abdication by the people of their right
to control their ¢wn affairs, which we
should never consent to, the very last
proposition for it which we would agree
to would be that made by Mr. Noble. The
tirst and fatal objection to be made to his
proposition is the character of men to
whom the city government, would be
turned over. They are to be in office six
years; to give their entire time exclusives
ly tg the ¢ity's business, and to be paid
$1,000 per annum. What sort of men would
offer for such a place as that, carrying
such a salary as that? No progressive
business man would have it at such a
salary. So that the only persons offering
for it would be the customary political
hacks, who look on politics as a trade
out of which they are to make a living,
and who, therefore, regard an office with
a salary of $1,000 per annum as a very fair
berth for a statesman out of a job until
he can find one that pays a larger salary.
This, every one knows, would be the char
acter of the men who would offer for
the places, so that we should turn our
selves over absolutely for six vears to a
set of men having no stake in life, having
no interest in the buginessg or the property
of the eity, and who looked upon their
places as their capital from which they
were to draw the very largest profits that
that capital could be made to yield, with
out any sort of regard to the interests
of those out of whom their profits were
to be derived.
Mr. Noble's resolution provides that”
these men are to be ineligible for second
or other terms. This provision bf the reso
lution is the capping-stone. If they could
be re-elected, a hope of re-election might
cause them to adminisier their offices
with some judgment and some regard to
the interests of the people of Richmord.
But, knowing that all chance to succeed
themselves was cut off, they would, of
course, have ho restraining influence, and
would use their places while they could
hold them to make them pay the last
dollar that was in the thing.
Mr. Noble's resolution provides that the
commissioner's who are to manage each
department are to be elected by his spe
clal Councilmen that we have been re
marking on. As those councilmen can
never be councilmen again, what would
they probably do in appointing these
commissioners? They would, of courte,
appoint commissioners who would agree
to ald them to get something else when

thelr six years’ terms were endel. and
they would require these commissioners
to agree to appoint no persons to any
place in the city’s government unless he
would pledge himself to work to seoure
for the Councilmen the places that they
had marked out ‘or themselves when
their term of Councilmen was ended. It
‘would rgsult, therefore, in turning the
whole of official Richmond into one vast
yollcar machine, worked for the advan
tage of the special Councilmen who wera
to hold office six years. A more perfect
plan for plundering this city and bank
rupting every tax-payer could not porsi
bly have been devised.
There are great ills in popular govern
ment, undoubtedly, but the correction of
those ills lies in the accountability of
public servants to the people at short in
tervals. Whilst we hold on tenaciously to
that part of popular governmen® we are
never in danger of abuses that cannot be
remedied. But when we part with that
principle and adopt the worst feature
of monarchical government, to-wit, ex
emption from acs ountability to the people,
the vital principle of popular government
is 10st, and we have commenced our drift
towards all the rottenness and corruption
that a Chinese Eniperor could ask for.

A movement was recently started in
Washington to form a cociety of sons of
Confederate veterans. At the prelimi.
nary meeting to adopt a constitution it
was proposed to incorporate a provision
which declared that one of the purposes
of the association would be to perpetuate
the principles of their fathers. This was,
of course, liable to the criticism that it
educated the sons of Confederate veter
ans to be advocates of secession, where
as the Confederate soldiers had agreed,
upon coming back into the Union, to
abandon forever all claim that a State
had the right to secede from the Union.
The meeting adjourned over without
finally acting in this matter, and it is to
be hoped that when it assembles again
the resolution will be so qualified as not
to make it liable to this criticism,
Whether it was this discussion that
prompted the “George H. Thomas Camp,
No. 1, of Union Sons of Veterans, to
take action in the matter, or whether
that camp simply wishes to make an im
pertinent interference with matters that
do not concern it, we know not, but ti
met a few eveaings back and adopted the
following preamble and resolution:
Whereas, it has come to the attention of
George H. Thomas Camp, No. 31, Divis
fon of Maryland, Sons of Veterans, U.
S. A, that at a meeting of the Confederate
Veterans' Association, held Thursday
evening, March 7, 188, at 910 Pennsylvania
avenue, Washington, D. C., the organiza
tion was considered of a body to be
known as “Sons of Confederate Veter
ans,’ to be located at the national Capi
tal; therefore, be it
Resolved, That, believing that it could
not be for the best interests of true pa
triotism; that ideas and sentiments would
be taught that must necessarily be detri
mental to a proper conception of .oyalty;
that as such a body would maintain prin
ciples that have-finally and irrevocably
been proven wrong: that as tne singulari
ty of the American flag should be held
inviolately sacred; that as such an or
ganization would necessarily have in
mind, if not in use, the flag of past re
bellion, therefore, we, the officers and
members of George HH. Thomas Camp,
No. il, hereby express our unqualified dis
approval of any such proceeding, beliéy
ing that such an organization
could not he formed nor exist in accord
with true American patriotism and loy
alty.
If this resolution was called out by the
proposition that was liable to be con
strued as adhering to the principle of
secession, we should feel disposed to
pass it by without remark. But if it
means, as its terms would indicate, that
this camp of Union Sons of Veterans
set their faces against the formation of
camps that are intended to perpetuate
the holy memories of the Confederate
cause, then we want to tell “George H.
Thomas Camp, No. 31, Division of Mary
Ignd, Sons of Veterans, UU. 8. A.” that
it 1s meddling most impertinently with
a matter that does not concern it. It
had just as well understand right away
that the Confederate soldier and his
sons are justly proud of the part that
soldier performed between 1861 and 1865;
that he would do exactly the same thing
again under the same circumstances, that
he has no apology to make for what he
did, and that his sons, under their fath
er's instructions, are going to perpetuate
the memories of their father's great deeds
and that their sons’ sons, to the remotest
generation, are going to do the same
thing. It had just as well understand
also that the civilized world is beginning
to rake off the coatings of lies by which
the Yankees concealed his performances
and the cause for which he fought, and
that it is commencing to concede with an
acclaim that the Confederate soldier was
the greatest soldier that ever bore arms,
and that he would have thrashed his as
saflant as many more times as would
have been necessary to make him desist
from his attack, in spite of the dispro
portion of three or four to one on the
field of battle, if he could only have got
shoes and blankets to protect him from
the elements, and food to keep up the
body that carried his uncorquerable
spirit,
George H. Thomas Camp had just as
well understand this now as later. The
Confederate soldier did what no other
soldiér ever came near doing. He is
proud of it; his sons are proud of it,
and those sons are going to keep the
memories of it green to the last descend
ant and the remotest generation.

foreman of a gang until Christmas last,
when he was taken with an attack ef
bacco in any form, does not know what
liquor Is except as medicine, never stayed
from home all night, and Was never out
of his bed after 9 o'clock at night. He

Jean de Resake, the great tenor, ridi
cules the idea of American singers going
to Paris or Italy to have their, voices
trained. He says that they have as good

and, of course, no American will dispute

tory building at 33 and 35 south Fifth
avenue, burned yesterday, causing a loss
of 3100000. It was occupied on all but
the top floor by Gillis Geoghegan,
steam fitters’ supplies, and the top floor
was used as a manufactory and work
shop by Nicola Tesla, the electrician,
The loss of Gillis Geoghegan is $60,000;
of Tesla, $10,000, and of the owners of
the building, $0,000,
The destruction of Tesla's workshop
comes just when it was whispered in the
scientific world that the inventor was on
the eve of one of the greatest of dis
coveries connected with the problem of
improving the electric light.
To the unscientific visitor, Tesla's
workshop was a maze of wires and
strange devices; but to him these intri
cacies and apparent mystery were as
plain as day. He worked at the shop
early and late, harder than any of his
mel.
Tesla is a Servian, He came to this
country ten years ago, and was for a
short time associated win Thomas A.
F.dison in his work. He has recently
received high honorary degrees from Yale
and Columbia Colleges.

In the Hustings ings Court Yesterday Judge
Muller again the absence of
Judge Witt, who is still confined to his
home ness. The following cases
were disposed of:
Commonwealth's Attorney Smith moved
that a nolle prosequi be entered against
the indictment of Park, the gold brick
swindler, in that court, having become
satisfied that the cas: properly belonged
to the county.
Mr. Wendenburg said that the case had
been transferred to the county, and that
under no other writ than a habeas cor
pus would the prisoner be produced in
this court.
Judge Mullen, who thought that the
prisoner was in court, since the motion
had been made, stopped the proceedings
at this point, by suggesting that. the ac
cused be brought this morning at 11
o'clock, when the motion is to be heard.
John Holloway, charged with
running a policy-shop, was fined and

colored, were charged with doing busi
ness as embalmers without having se
cured a license, They were acquitted.
This was the first trial under the new
law against unlicensed embalmers, passed
by the Legislature at its last session.
Stephen Lee (colored), sometimes called
Samuel Lee, chacged with house-breaking,
was acquitted,
William Lewig (colored), charged with
betraying the affections of his sweet
heart, was acquitted,
John Smith (colored), who is said to be
of unsound mind, was brought before
Justice Crutchtield yesterday morning,
and a commission was appointed to look
into his mental condition.
Eddie Lewis, a colored boy, who had
stolen a can of tongue from the store
of J. H. Stout, was, by order of the
Justice, whipped in court by his mother.
Mary Johnson and Mary Newman, both
colored, who we; charged with assault
ing each other, were discharged on pay
ment of costs,
Danfel Thomas (colored) was sent to
jail for sixty days for stealing a spelling
book from Tom Grimes,
Henry Winter was sent to jail for thirty
days for stealing a horse blanket, whose
owner, however, has not yet been found.
Hattie Harper and Harriet Porter were
fined $2.50 and costs each for disorderly
conduct on the street,
